Dud purchase with Paypal payment - where do i stand?

    Hi guys

Looking for some advice here. As some of you know I have a T4 with problems and have traced it to a faulty diesel pump. I got contacted on the T4 forum by a guy who said he had a perfectly good, useable pump that he had removed from his van as he had replaced it with one with new seals for a veg fuel conversion. He said it worked fine so i purchased the old pump off him and sent it straight to a diesel specialist for TESTING. I got a call today from them saying there was a broken oil seal in the pump so they have rebuilt and replaced it. All done without asking me first, and a hefty bill.... They are at fault with this and they know it as I only asked for a test. if they had tested it and said it was faulty I would have gone straight back to the seller politely demanding a full refund and would have sent them back their faulty pump.

I paid for the pump via paypal thinking I would be covered. I have just emailed the seller saying this and asking for a refund however I cannot send back thier faulty pump so I have suggested I send back my faulty one instead - fairs fair, one dud pump for another???

If he refuses to do anything, is there any chance if i open a dispute with paypal I will stand to get anything back? Bearing in mind I will have to send back my faulty pump and not the faulty one he sent me... I kinda hope so as with a new house purchase I cant really afford to lose out on this atm.

Any advice would be greatly recieved.

    Thanks
    Chris

to be fair, if you said to me "i bought the pump off your runing engine, sent it to be checked and they said it was ****ed but they fixed it without asking, i want my money back"

id tell both you and the diesel specialist to go forth an multiply in short, sharp jerky movements if im honest.

i think the diesel specialist has led you up the garden path, and making the seller look like he sold you a duff pump, when it may well have been fine.

but you will never know the truth sadly

i would not pursue the seller,

but chase the company for doing non authorized work

my opinion, dont take offense intended

Agree unfortunately. The moment the company messed with it you unfortunately lost any comeback on it with him. Now its between you and the company, the pump could have been fine and they could have just been after some work. Unfortunately you won't know.

Thanks guys, I was thinking this too and I do accept the specialist messed it up seeing as they didn't let me know before they did the work. Unfortunately I'm going to have to suck it up but I am a bit miffed. Just wondered if PayPal would have helped out but I don't think so....

The pump may have been running fine in the car with no visible issues in normal use. If you had fitted the pump and it didn't work you could have returned it as it was not as described.

I get stuff in at work all the time that works ok, but if you stripped it you would find wear and parts that should be replaced. If I have serviced the part it needs to be 100%, not just worn out but still holding on. They may be the same, replacing worn parts to bring the pump up to 100% cndition/cover themselves.

I would not pay for the pump to be repaired if you only requested a price to repair and they did not contact you. If you just asked for the pump to be serviced you would have to read the small print to see what you agreed they would do in the event of parts requiring replaced. Personally I always phone to check with customers before replacing parts on top of a service charge unless the part price is marginal.

If you're lucky, you might get a little bit back from the seller as a goodwill gesture ,if he's a decent sort of chap but have to agree, as soon as it was played with, any chance of getting money back has become remote. As for sending your pump back, I don't see that he or paypal with go for that option, as it's outside of any rules and regulations that you'll find in their small print.

Afraid it's just one of things that you might have to take on the chin, bad luck.

Cheers guys. I do agree with all of you and unfortunately I think im going to have to take it on the chin.

I cant even really have a go at the deisel specialist as its a mate of mine and he said it would have been £400 to do it but he isnt charging that. My reply was quite polite as I said " I only asked you to check it though mate".... Oh well, guess its one of those things im gonna have to suck up.

As the sayig goes "Suck it up pu55y!"...

Ah well, at least it wasnt life and death and I can laugh about it already. Shame really as I think I have got to this point as its just 1 more nugget on the huge pile of dung to come my way recently!

Thats a pity bud but your specialist shouldnt have ploughed on ahead with refurbing it without you agreeing first.

If it had been an issue with original seller and yourself certainly i could have stepped in for you but not now its gone this way.

Main thing is.........is you T4 sorted yet lol

I appreciate it's the specialist who messed up here and his excuse was "it had engine oil in the pump for some reason and I couldn't test it with that in it" so he did the strip, clean and rebuild with new seals. Didn't even consider calling- makes him a t0553r in my book. Only Picked it up yesterday and haven't had a chance to get it fitted yet but hope it solves the problem!

I know the feeling, I asked a workshop to have a look at a gearbox once, they stripped /rebuilt it without my say so, cost more than double the cars worth The Quote " dear-bought experience" springs to mind .. but on the bright side, at least you now have a reliable pump & a working van You could ebay the other pump (spares or repair) recoup a couple of quid maybe ?
