    PCN - wrong number plate

    Hello all

Received a PCN for not displaying by parking permit in the windscreen; I have one, but appears it had fallen off.

On opening the printed ticket, they've written the wrong number plate

Have I gotten away with it, or should I follow up and tell them of their mistake?

    Cheers

you should be able to get out it since it is a mistake on there part, it depends how wrong it is. Guess you could produce your permit and say it was clearly displayed at the time of leaving your vehicle and ask them to prove otherwise.

      Cheers Greg

It was out my one incorrect letter, ie a W instead of an M.

If they've got the wrong number plate, and I refuse to pay, where would they send the fine documentation to?

Unless they've taken a photograph of it?

I would be cautious with this one. In my area, North London (Enfield Council), they have taken to photographing every parking offence with digicams.

            Interesting Tim

TBH, i've never seen any wardens in my area.....ever, so can't say whether they use cameras or not.

Their office isnt far from where I work at present, so i may go in person to discuss.

              in the clear

As far as i can see you are in the clear one of friends up here owned a cossie
the start of his reg was F *$£ SNP he passed a cop car in speeds of excess of 130mph the cops tried to go after him but gave up, instead they went round to house by this time of course the car was back in the lock up, they dragged him out of the house got him to open his lock up and felt the bonnet of the car and said this car was out and that he had passed them at a hair raising speed at charged him there and then.
When the letter came from the sherrifs court he noticed that they had put E £$% SNP on the court order instead F£$% SNP so he kept his mouth shut and waited till the summons and stood in the dock only for his solictor to say to the judge could you read out the registation of the car and the judge let him off with it and gave the two officers a good dressing down for wasting the courts time

Basically the PCN has been incorrectly filled out and shows the wrong details so it is invalid.

In your position I would write to the council who issued the PCN straight away (or within 14 days) saying that you have been issued with a PCN that has not been correctly completed (as per the Road Traffic Act 1991) as it does not show the correct registration number of your vehicle.

You could then go on to say:

As this appears to be a very straight forward and clear cut example of an incorrectly completed and therefore invalid PCN, I ask you to cancel the PCN forthwith.

If you decided not to cancel this PCN and you decide to pursue this matter, I would ask that you send me a complete copy of the PA’s relevant notebook entry in regards to the issuing of the PCN and any further evidence, photographic or otherwise.

If need be I am prepared to go to adjudication at the Parking and Traffic Appeal Service to this settle this matter.

It is worth noting that The Road Traffic (Parking Adjudicators) (London) Regulations 1993 Section 12, gives the adjudicator the authority to make an order for costs and expenses to be paid, if he is of the opinion that the local authority has acted frivolously or vexatiously or that their conduct in making, pursuing or resisting an appeal was wholly unreasonable; or where it considers that the disputed decision was wholly unreasonable.

                        -----

this sort of letter usually works for me. I once got off a PCN at appeal because a traffic warden for some strange reason called my Audi a Porsche

As an update, just received a letter stating they won't be taking this any further

For future reference, all I did was to send them a letter, asking for photographic evidence that it was my car they'd ticketed. I didnt state the correct number plate, nor did I provide my home address or anything else that could have linked me to the car.

A nice start to the weekend

nice to beat the system for a change well done. Now you can spend what you would have to spend on the fine on your car!!

Well done... It ALWAYS worth challenging parking tickets for ANY reason, as it is often costs the council more to fully investigate a challenged PCN than the PCN will earn them especially when the fine is at the reduced rate. The councils/private contractors would rather focus on the straight forward non-payment stuff which is far more profitable.

I have got off 12 PCN's in a row in the past few years, not all that I should have won, but it goes to show it worth a try.
