    legal advice with shoddy work!

    A tail of wo... Just an over view.

    November involved in a 'no fault' accident, the insured and their insurrance company both admit full responsibility.

    My vehical was hit hard on the NSF wheel/corner forcing the car sideways across to lanes into and over the curb coming to rest against a wall on the OSF.

    Damage noted;
    general damage to NS of car including front bumper, front wing, drivers door, mirror, headlight, front wheel and tyre.
    light damage to OSF wing
    Steering out of alignment and car 'pulling' to the left.
    brake warning light on and no 'servo effect' for either the brakes or steering on start up.
    ABS 'cutting in' when braking to a complete stop, causing the car to over shoot by a couple of feet. Happens in both forwards or reverse directions and just in the last 5mph.
    Also noted but not delt with through the insurrance is the fact the cooling fan was running contastly after the accident, I pulled the relay and pointed this out to the person who delt with me when I presented the car for repair.

    Problems/issues encountered since my vehical went in for repair;
    No communication, I have done all the leg work, phone calls etc chasing this repair apart from enterprise constantly chasing me for their car back as Direct Line had off hired the car even though it wasn’t ready. Over 30 phone calls to date. I stipulated that the best way to contact me was by e-mail as I work on Oil rigs and todate I have received no e-mails!

    Vehical not touched on my return from work in December, the Engineer some how came to think I was in the Army and not back for 6 months????!!!

    Asked for quote on stone chips, later head lights etc at this time.

    On my return from my next work trip I was called to say car was ready (hire car company wants their car back) but on further investigation by myself found that the safety critical items eg brakes/ABS had not been done so car was not ready... after 15 phone calls between bodyshop, third partys insurers and the hire company and one cancelled flight and a days work lost I get the hire car extension agreed to the 19th of Febuary.

    Received a phone call from bodyshop from manager saying did I know my cooling fan did not work and the car was over heating even though I had reported this to them earlier!!! Also the Engineer was made aware of this by myself.

    Rang bodyshop and Audi garage (car went there for mecanical work)to check on my vehical progress and was ashored my car was all ready for me and all faults were resolved.

    On delivery back of the hire car on the 19th of feb (as instructed) was told the hire had been back tracked to the 16th and I would incurr the excess cost, branch manager of hire company rang insurrance company to see why it was changed, they refused to dicuss it so I tried to sort it and the insurance representive quite rudly refused to discuss. I am still waiting on a refund on my credit card from this todate!!!

    On collection of my car, I found;

    Scratch/scuff on front bumper
    Quote/requested extras not done.
    cheap non-matching tyre fitted (matching tyre still readly avalible)
    On driving off the car ran extremely badly, 'kangarooing' up the road, fuel light on, limped into ASDA for fuel.
    As the car warmed up sweet smelling steam came out of the face vent's and misted up all the windows badly, the car at this point was basicly undriveable so I limped home and rang bodyshop to report, I was asked to come back on the 20th and the manager would look at the car.
    the manager at bodyshop was not 'avalible' so a receptionist came and looked over my vehical taking notes and ashored me the manager would call and sort things out.
    When I atempted to drive off the vehical 'kangarooed' to a halt and became imobile, so I went back to reception gave them the keys back and requested a loan car.

    I was told the Engineer would be in later and I requested he call me back to discuss the problems, no call todate.

    Any advice as to where to go now? they are saying 'not there fault' so its down to me to sort!!!

    Write down all the faults noted and hand it to them, keeping a copy for yourself. Agree a confirmed date for collection. Explain that if the work listed is not done to your satisfaction (again all written down) you will have the work done elsewhere and bill them for the full amount, send a copy to your insurance company also.

    Should get them moving, do they know what an S2 is?

      Don't take the car back until you're happy with it. A mate refused his car 4 times and even then it wasn't to his satisfaction when he got it back a month late! Keep your insurance company in the loop so that they know what's going on. Doing all the leg work sounds like a normal state of affairs. It's ***** but if you want something doing properly then unfortunately you have to do it yourself.

          writen instructions

          Yeah everything is now writen down and by e-mail, the Audi Dealer just rang and said he thought the head gasket has gone car runs at tick-over smoothly with no smoke but will not rev!?! Also they said the overheating was due to removel of the secondary rad even though its been like this for nearly 3 years (and after they were told the relay to the fan was pulled!!??).

          There is a lot of b***ks being said and everyone is contridicting each other and also blaming each other but this doesnt help me get my car running!!!! I am keeping notes.

          Corey if I get the car transported to you will you put it right and write a report? I will sort the bill and reclaim off them?!?

          I am pulling my hair out (which is hard with a skin head lol), proper stressed! I just want my car to be like pre-accident so I can then get you (Corey) to do your wonders.

            Unfortunatly my insurers aren't involved at the moment as the third parties insurers said they would take care of everything lol and they dont seem to want to get involved as well

                    I had huge problems with Privilege (aka Direct Line) with the wife's pride and joy, just over what the car was worth and whether it was a write-off, fortunately we had got the car to the garage we normally used.

                    Anyway best advice keep a complete record of all calls and problems and get the insurance ombudsman involved, it tends to focus the insurance companies attention, and if I remember rightly costs them more money if the ombudsman gets involved as they have to pay the ombudsman

                        Wow and I thought I was getting shafted by insurance companies!

                        Have to say, I spent £250 of my own money to have my car shipped to Corey after an accident. Best decision I made in the whole ordeal. The car not only needs to be in the hands of someone who knows what it is, but also someone who will take the **** off the insurance co. and deal it back triple-fold.

                        In my case, justice has been served

                        Unfortunately, keeping on top of it and being a difficult and arsey b@stard is the noly way you can get it done. Trying to do it 'properly' will only lead to frustration. Definitely get the ombudsman involved, I emailed them and they opened a case right away and got an email back offering to register a formal complaint against the insurer. As it happens, it wasn't neccesary

                        It is your legal right to have the car back in pre-accident condition and don't accept anything less. You should also not be out of pocket. Be sure to claim for your inconveniences - lost time, phone expenses etc - pile it all on and royally take the piss, you certainly won't get it all but they will probably accept responsibility for some of it and you'll at least get something.
