B'stards!!! What are their reasons for insisting on keeping the salvage? I was under the impression that only CAT A salvage has to be destroyed. CAT D and C cars can be put back on the road with some CAT C cars requiring a inspection to confirm that they are NOT ringers using stolen components.

CAT B cars can be salvaged for parts only, the VIN can NOT be used but apart from that all other components can be.

I have checked back through me records and this is what happened and what I had to do with the paperwork in the case of my Corrado.

The car was first taken to a salvage yard in Cardiff where the accident happened, this was arranged by the police. I went there the morning after and collected my possessions from the car, I asked what the next procedure would be and was told that the car was to be taken to my insurers nearest approved salvage yard for assessment. This happen the next day.

Two days later I phoned my insurers and asked if the assessor had seen the car yet, they said that they thought he had but were yet to get his verdict so I asked for the details of the salvage yard so I could contact them to see if they knew. They did and confirmed what I suspected that the car was a CAT B, they went on to say that the car was due to be picked up the next day and taken to yet another salvage yard miles away.

This is when I started to get alarmed, I told them this would not be happening and that I was keeping salvage myself and for them to instruct their driver to deliver the car to me. I was told I had to arrange this with my insurers and after a lot of phone calls back and forth between them and the salvage yard I managed to get them to agree to do so. At this stage they had not requested the documents and we had not started to discuss a settlement.

The car sat untouched on my drive for the next two months whist me and the insurers haggled over the settlement, once I got what I was thought was fair we agreed and I was told to send in the documents. However because I was keeping the salvage in the case of the V5 I was told to send a copy as I would have to declare that I was scraping the car myself and would have to inform the DVLA once I had done so.

I did as requested and five days latter a cheque arrived as arranged.

Sorry for the ramble but I thought I would give you as much info as I can.

Your insurers have more than a cheek to advertise the salvage before a settlement has been reached and as far as I can see are acting outside the law.

Seek legal advice and inform the police.

            Update

            Hi all

Thankyou for all encouragement.....at times it does seem i am fighting a loseing battle, but after i saw auction ad,this morning,my bloods boiling and i am fired up again.

Rang the salvage yard ,left message on service informing i STILL own the car with all paperwork......not accepting the insurance company offer, still fighting them....AND remove from any auction they are thinkiing of.

I also rang the assessor ( TECHNICAL SERVICES EXECUTIVE CRAIG P@@@@)
left meesage asking what he doing,as car mine/papers with me ,i rejected his offer....and i would be chatting to police.

Police say its cival matter till car sold....as i havnt recieved money/accepted offer...and i got papers still.....their actions do seem unlawfull.

Tomorrow i see a lawer or CAB which i can get to first, and will ring salvage yard at 830 to inform them of the situation....and see what they say.

My brother has a newspaper man he used to sort his insurance claim out...and i will be using him if nessary..to sort things i hope

Thankyou all,and i still need you support and ideas ,and a spare lawer if you got lol

            Cheers
            john

@John - fight them to the end sir... I cannot believe the downright cheek of these toe rags - they are all in cahoots together - they all get a cut and the innocent owner (YOU) get shafted to the core.

                      Update

                      Hi all

Again i wish a great thankyou to all ,who wished me well, and gave encouragement and great advice,i will admit that there was times i wanted to give up.....and too, friends who thought i was mad to carry on as i did, i have shown them otherwise( not n here)

First thing this morning i was down ti CAB office in Shipley, very helpfull, then sent me off to chat to CONSUMER DIRECT,(08454040506)...and they, where great too, supply a great amount of info........instructed me to chat to the OMBUDSMAN (08450801800)....

They all said ,the same as my friends on here, their behavior was a little unusaul.....and gave me options

                      BASIC BACK HISTORY

I been over last five years buying varies cars and when necessary been breaking and selling items, i been using a dismantling yard to legally dispose of the shells, they are very good dealers and very fair ,AURTHER BROTHERTONS in GUISLEY......I explained my dealings with them and that he or assessor could contact them to varify my transactions..................
the said i had good cause to get my salvage wreck back

By now,the assosser had tried,to reach me five times and once i explained, who i chatted to and what they said and i wanted my car back .....he wasnt happy.............also seemed suprised i had info on auction.....till i mentioned item no,he said he would contact salvage yard, and his adviser and work things out

He did ring back, and short end of it .....my car coming home
i forfieted the payout,i ok with that

So in short fairness has won.....

I wont say alls well tilll the complete car in on my dads drive, then i will ,celerbrate and chill out

So again thankyou all for your support

                      cheers
                      john
