MOT Test and spare tyres

Am i correct in thinking it's a fail if the spare is illegal, but if there is no spare then they can't fail you for not having one???

that used to me the case, like gaitters if they are split is a failure, but if there is none is not a failure. (i assume it is still the case)

That used to be the case and I guess it should be the same now as my wife's mini does not have a spare wheel at all!

I never knew about the gaiters though!

You don't need a spare so it cannot be tested if it isn't there - that's even true of things like lighting: a car cannot fail on certain lights if they are not fitted, but it would probably fall foul of construction and use laws - it can still pass an MoT.

The spare tyre is not tested they can only advise if it is below legal limit
