Hi,
Need a bit of advice regarding a car sale that I walked away from late last week...save chapter and verse, here's the summary
Saw a listing on ebay for a car, I knew the car had failed it's MOT on 3 things itemised in the listing:
Wiper blades
blocked washer jets
front discs and pads
So, on the face of it nothing major. Made enquiries and asked specific questions about condition and any noises, creaks, leaks and groans etc, not least from the gearbox and aircon, all of which they confirmed via ebay message were fine.
I went out to a Christening so was not about to bid on ebay so made an offer before I left which they accepted. I then agreed to pay £100 deposit to secure the car and they would use that to buy the parts and get it MOT'd last week.
After probs getting it into a garage for the work, i said i'd come up and view the car and double check everything was fine and potentially they could drive it to me (their offer and thus risk) or i would do the failed items and get it MOT'd myself up there.
On arriving to inspect the car and check the VT30, I found 10 items it failed on
, not the 3 they listed or confirmed over the phone along with a host of other bits, aircon not working, airbag light permanently on and the car not able to idle below 1400rpm, though peaked at 2000rpm
Naturally I said it was not as described or confirmed and not proceeding with the sale on that basis and that I wanted the deposit back into my paypal.
They are now witholding that and claiming it to cover their costs???? which is total b**lsh*t.
I have raised a dispute on paypal (even though the transaction was not done via ebay) but I have now found they have re-listed the car and still failing to disclose the full extent of the faults and now requesting a 'non refundable' deposit for any other unlucky sod who actually wins on ebay.
What are the options open to me to force the £100 out of their sweaty, grubby little mits? I have suggested that if the money doesn't come back I will start a small claims court action and have a chat with Notts Police about theft/money by deception but I guess that will prove fruitless. Any other options?
I know I've been a complete thicko to part with anything ahead of seeing the car but i spoke to them, emailed specifics and did all the checks I could to verify the car beforehand...?
Thankfully I did secure another car over the weekend which is a peach, so all is not lost
Cheers
David
