They might be trying to stall you to rack up the costs of storage, you should be intitled to remove it and take it home at any point since its yours.

You remain the legal owner of the car until you have agreed a settlement sum and exchanged the logbook for the cheque. (remember my earlier advice....never accept their first offer, it WILL be offensively low)

Until then you have the right to control where the car goes, particularly if there is a chance of being charged for storage. That is the reason the car is usually moved quickly, as the insurance company don't want to incur storage charges any more than you.

Technically they should have asked your permission to move it, at which point you would have said 'yes, please move it to my driveway' howver they do. Therefore you should demand that they do this now, however depending on how you decide to handle your them, you might have to pay to move it now...your call. Since the car has already been moved, you have to try to understand how your insurance company operates and whether you trust them.

The normal procedure is for the insurance company to offer the car for scrap and get bids on its value. The question is, are the insurance company doing it themselves or using an independant assessor (who makes money from getting the most for scrap and giving you the least)?

Either way, take control of the procedure. Tell them that you want immediate access to the car (to make sure it has not been stripped) and that you will be moving YOUR car to YOUR drive for safe keeping. Inform them that you will happily give access to the car for their assessor and look forward to meeting him/her to discuss the cars value and condition.

The fact that it has not been assessed is good. It means you can lower its scrap value (and therefore your buy back costs) by removing all items which are not covered by your policy before the assessor sees it and also talk to him/her when it is finally assessed.

        Cheers n

            Refuse their offer!!!!

I managed to get my CAT B!! VR6 Corrado back after a fight, you are entitled to get the salvage back unless the car has been graded as a Cat A.

They will try and fill you with all sorts of *****, ignore all of it. Obviously the car can not be put back on the road and you will have to make painfully clear to them that you have no intention of doing so. do not refer to it as 'your car' instead call it 'your salvage' as this will help to make them understand that you want it back for parts.

Get your insurance company to give you the contact details of the storage yard, they are legally bound to do this. Then contact the yard and tell them that under no circumstances should the car be moved unless it is being taken directly to your address, also point out to them that the vehicle is still your property and that you have yet to settle with your insurers. They should then start to listen you, threaten legal action if you have to and DO NOT send them the V5 until you have the car.

I managed to get my car back within a week after a lot of mainly angry phone calls to both the salvage yard and my insurance company. However I did not settle my claim for another two months and after a couple of well written letters to my insurers.

In the end I got them to pay all the storage fees and all the transportation fees including delivering the car to my door. I got a fair value for the car which at time was about £7000 and I got the salvage back for £350 which was deducted from my settlement payout along with my excess.

              That's good advice

As we have all been saying...be prepared for a fight. Refuse their offers, do your homework on both your rights and the cars value but do NOT mention the extra bits, as they will rightly increase the scrap value. Tell the insurance company that you WILL keep the car and that they have 7 days to deliver it to your door. Only then will you discuss a settlement and accept a fair value. Refusal to comply is technically theft. Tell them that you have been advised of your rights by the CAB

One final comment to get you wound up and punchy.....the if your insurance company are offering to pay you net £250, I would bet that they will get more for the car when sold via an independant insurance assessor, so that would mean they make a profit on your misfortune....DON'T LET THAT HAPPEN!

              Now go get 'em

              Cheers n

Think thats taking the mick just a bit if its still your property, i'd be on to them straight away in the morning and demanding it be delivered to yours and get a solicitor involved.

What a bunch of ****#oles the assessors are and i cant believe that even tho its not settled they are already advertising it!
If you still have the V5 let them sell it and claim it as stolen!

I want that rear panel been looking for one for a while.

Seriously tho, is there anyone you know close by with a trailer that you can drag it out and home on. Whilst its left there it will most likely end up being sold unless you kick up enough of a stink or get the police involved and say they are trying to sell your property.
