Still a bummer for you but at least the owner is willing to rectify where possible. He is probably highly embarrased about the whole situation. Down to you now though and what you want to do.
The recent news is a silver lining to this whole situation. I feel for the loss of your car. This could have so easily turned into a legal battle. But i think it is a testament to your good will, patience and honesty and also the garage owners.
With any luck you will find a different car that you like (the RS4 will be difficult to replace without constant comparison) And hopefully you will get your old car back also, that should still have some value in parts?
How much do you think your RS4 was worth, out of interest?
To be honest, there was no amount of money could have bought that car from me, as far as value goes and if a car with the mileage and condition, i suppose to the right person who knows what they are looking for you would be looking at 20k upwards??

Well, i don't feel you can put a monetary value on such things
I totally agree!
I was just curious because whatever he choses to replace it with will have to have an equivalent price i assume?
Then we can all chip in with exciting suggestions as to what he could buy , it may give him something to look forward to, it would me anyway?
Under most circumstances buying a new car can be quite exciting but i understand this situation is probably quite different... understandably so!
I hope whatever you choose will help take your mind off the loss!

Glad you are on the way to sorting it.
Your right it wouldn't be the same if my workshop or another hi end repairers had repaired it,,, it would be better! better because robot paint finish is only so good. One reason why I have "old" cars, I cannot stand the orange peel from the factory! not that they were better back then but it makes no sense to strip a new car for a repaint!
Let me know if the "salvage" is for sale?

The guy selling this is on Audisrs.com it to has been meticulously looked after, cant remember his log in name (will have a look) but there are numerous posts on this car with some fantastic pictures.
With regard to taking the money or pursing through the courts, its a no brainer you seriously have to take the money. I have to deal with these sort of court cases on a monthly basis.
Ultimately you would be seriously worse off as the garage owner has said he will replace your vehicle to one of your choice, the bottom line is the judge would see you as being greedy as there is no case to answer and no dispute as your losses will be completely covered.
It will all come out when he submits his defence and your case would be seriously dented, in truth his lawyer will probably advise him to submit this as a Part 36 offer. If you decided to accept it then you would still suffer your own costs up to that point. If you dont accept it as a Part 36 offer and you continue with your case and ultimately the judge decides the settlement figure is less than the Part 36 offer you will suffer a large % of his costs to.
If he has said that he will replace your car and clearly there is one on PH that could not forgetting that the courts wont be sympathetic to "well its not the same I will always be comparing" you will not get as good a settlement that he is offering you now.
There is no such thing as a cut dried case, please please please take the offer and put this behind you.
It would be an absolute no brainer for me, i urge it to be for you..
mallster I take my e-hat off to you. You seem to be dealing with this in the correct manner by not naming the garage and working towards an amicable solution between the two of you. It would have been so easy for you to come on shouting and balling about "hibbys garage" being this and that but it would not have got you anywhere.
BTW your story seems to be spreading around the net. seen this linked to on scottishvag.net
